This is harder than I thought

I work 3rd shift weekends at a hospital so my mind is usually fried by the time I get home, so I don’t know why I attempted to fill out some of the paperwork right after working a grueling shift. This is going to be tougher than I thought  it would be.

First I started with the Enforce a Court Order to Pay Support paperwork. I am so overwhelmed! I have to go back and find the original order because I need the name of the judge that signed the order to pay support, I need the original complete wording of the order, I need the amount past due and the date that happened… the problem is, we’ve gone to court numerous times for this. So, do they want name of the original judge that ordered the support or the judge that signed the most recent document? How am I supposed to figure out as of what date he owes what money? He paid off and on until 2001 and then he stopped completely! After I figure out that whole mess I have to take it down to the court house, make tons of copies of it, and file it. The filing fee is $61.00, which I have to pay out of pocket, but in addition to that, the courst said there MAY be an appearance fee of up to $250. What?!

Then, I have to pay to have him served. I can either go to him and ask him to sign paperwork showing that I served him (ya, I’d rather have a root canal), I can send the papers registered mail, UPS, Fedex, something that will get his signature, I can serve him by Sheriff’s Office, or I can have a process server serve him. Again, all of this is out of MY pocket. I can ask the courts to order him to pay me for all these fees, but that will have no consequence to him. He still hasn’t paid me for all the other filings I did.

I am starting to wonder what use this all is. I know he doesn’t take this seriously at all. It’s just like that dumbass rapper DMX that keeps getting arrested in Phoenix. They keep letting him otu with a slap on the wrist and he keeps getting his ass arrested for other stupid things. This is exactly how they have dealt with Lonnie. He gets letters from DCSE saying that he owes and he ignores them. They sent him notification that his wages will be garnished so he doesn’t get a real job. They sent him a notice that they are going to intercept his state and federal tax return, but oops! He doesn’t work, therefore won’t file taxes. They say they will seize his assets, but that doesn’t matter because he has nothing in his name, even though he has a lot of things. Nothing is going to work with this man except for hard jail time.

But, of course, the state does not care.

I’m just so frustrated…

Filing request to enforce order

I went online to our county’s Self Service Center and downloaded the forms to Enforce a Court Order to Enforce Support. I also downloaded the forms Service of Court Papers. Personally, I don’t know why I should have to file a motion to make enforce the support order. He has already been ordered by the court to pay, and he is willfully not complying with that order. Why does the burden then fall upon me to spend my money to make sure that order gets followed? I don’t know, but the wonderfully helpful (note the sarcasm) guys on the phone at the DCSE said that is precisely what I have to do.

I don’t even know how much money this is going to set me back. Back in the good ol’ days (snort) when I was unmarried and not making very much money I was able to file and not pay anything because I made under their income limit, but with my husband working 2 full time jobs and me working mine I am positive we make too much now. I feel it is so unfair that I have to spend money I don’t even have to make the state force him to comply with the judge’s order.

This may all be a losing game, anyway. I just read online through public records that he is due to appear in justice court on July 29th for an arraignment hearing. I have no idea what it is for. With my luck I’ll pay all this money, have him served and he’ll just end up in jail for this other incident and my money will be down the drain. Again. Hey, it’s happened before.

New Blog, New Journey

Welcome!

As you have probably read on my other blog, My Life…MyLove…My Insanity, I have been struggling to collect child support from my oldest daughter’s bio-father since she was born. I plan to chronicle my journey from this point out, mostly to be able to keep tabs on what’s going on in the case so I can have something to refer back to, but also so that I can be of assistance to anyone else out there that is dealing with the same issue.

I hope for a day when people are accountable for their decisions, and that if said people aren’t being accountable, then the laws that are set in our states and country will work as they are supposed to – and put a swift kick in the ass of all the deadbeats out there.
